Notification
General requirements for participation
Applicants are allowed to participate in this procurement
procedure by itself or jointly with other suppliers. In the case of
joint participation, participants have to decide on a
representative who will contact DOCOMO at every stage, including
application, selection and contract negotiations. Although DOCOMO
will contact and negotiate with the chosen representative, all
joint participants shall assume every obligation and liability
related to this procurement regardless of their status. However,
suppliers who fall under any of the following conditions cannot
participate in the procurement:
- (1) Those who have been adjudged to be
placed under guardianship pursuant to article 7 of the Civil Code
of Japan, or who have been adjudged to be placed under curatorship
pursuant to article 11 of the same code.
- (2) suppliers adjudicated to be
bankrupt, and who have not yet been reinstated;。
- (3) suppliers under composition,
corporate reorganization, bankruptcy or liquidation proceedings;
- (4) suppliers who, within the last two
years, or suppliers who employed person(s) who, within the last
two years;
- (a) intentionally or by a gross mistake did poor or
faulty work in the manufacturing, supplying and delivery of any
product or in the provision of any services when performing a
contract with DOCOMO (hereinafter referred to as "Contract"), or
committed any unfair act with respect to the quality and/or
quantity of any product supplied thereunder;
- (b) conspired with other supplier(s) or applicant(s) to
obtain unfair profit in making any application (hereinafter
referred to as "Application") or entering into or performing any
contract with DOCOMO for the procurement of a product;
- (c) interfered with other supplier(s) making an
application or entering into or performing a contract with
DOCOMO;
- (d) interfered with, or refused or failed to cooperate
with DOCOMO personnel when they performed an inspection or
supervision duty;
- (e) failed or refused to enter into or to perform a
contract with DOCOMO without justifiable reasons;
- (f) made a false report or misrepresentation in the
application procedure or in entering into or performing a
contract with DOCOMO;
- (g) violated the confidentiality obligation prescribed
in Procurement Documentation;
- (h) misused Procurement Documentation;
- (i) committed any unfair act in DOCOMO tenders to
interfere with other supplier(s) in competition;
- (5) suppliers who are deemed to have
gained unfair competitive advantages as a result of their direct
involvement in the preparation of the final Procurement
Documentation and/or technical specifications for this
procurement.
